BBC Kids Collection Terms and Conditions
2020
Deadline:
Applications must be submitted to the Getty Images platform by the deadline specified in the Brief in order to be eligible for consideration.

Format:
Photographers and videographers can submit an application that should include:  (i) a link to existing portfolio of work online; (ii) submission of up to 500 words summary of their proposal to capture the elements of their selected Brief through commercial photography or videography, and how they will utilize the seed fund for creating content in response to the selected Brief; (iii) a short biography detailing the applicant and what he, she or they have done; and (iv) additional required fields indicated on the Brief detail page.

Only digital submissions via the platform to Getty Images will be accepted. Prints, books, slides or transparencies or other such materials will not be reviewed nor returned to applicant. The proposals must be in English.

Eligibility:
The seed fund is open to individuals who (i) are residents of the UK; and (ii) are of legal age of majority in the UK as of date of entry.

The seed fund competition is void outside those jurisdictions and where prohibited by law.
Employees of Getty Images, BBC, and their parents, affiliate companies, subsidiaries, partners, and each of their respective immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. Contributors to Getty Images who are not employees are eligible. Any party on a seed fund application may appear on only one seed fund application per year in respect to this Image Set.
By submitting an application, applicant certifies that he or she is eligible to apply for the seed fund and agrees to be bound by these terms and conditions.

Funding:
Recipients may be awarded up to £1,000 per individual. The amount of the seed fund distributed to each individual shall be determined by Getty Images and BBC in their sole discretion. Getty Images and BBC shall have no obligation to pay out any or all seed funds, in any proportion, to applicants. Distribution of the seed fund is subject to recipient entering into a separate agreement with Getty Images allowing for the distribution of your content.

Contact and Communication:
Getty Images and/or BBC employees may contact seed fund applicants for further communication relating to the seed fund application.

Insurance Coverage:
Released Entities (as defined below) nor their insurers provide coverage to seed fund recipients while they are pursuing their Brief projects.  Seed fund applicants are at their own risk as they pursue their projects and Getty Images strongly recommends that any photographer, videographer or other partner working under any circumstance, but in particular a conflict zone, secure independent insurance coverage and have a clear understanding of what that insurance covers, in particular long‑term health and disability coverage.

Intellectual Property:
No materials and ideas contained within the application will be used by Getty Images, BBC or selection panel for any purpose other than the review and selection process for the seed fund and for publicity (as outlined below).

Applicants retain the copyrights to any imagery or video submitted to Getty Images for review, and to any imagery or video they produce in their Brief project. Only imagery or video to which the applicant holds the copyright may be submitted. By submitting an application, applicant certifies that his or her application will not infringe the intellectual property right, right of privacy, right of publicity, right of morality or other personal or proprietary rights of another person or entity.

No Manipulation of Creative Imagery or video:
With respect to creative imagery or video submissions, your application portfolio may not contain images or videos that have been manipulated ‑ either digitally or through staging ‑ in violation of generally accepted professional standards.  Determinations of unacceptable manipulation will be made at the sole discretion of Getty Images.

Photographers are advised to heed the U.S. National Press Photographers Association's code of ethics with respect to image manipulation which dictates that "Editing should maintain the integrity of the photographic images' content and context. Do not manipulate images...in any way that can mislead viewers or misrepresent subjects." Cropping images to remove extraneous detail is permissible, as is the removal of sensor dust or scratches on scans of film images. Examples of prohibited digital manipulation are: the addition, removal or alteration of people and elements within the frame; tonal adjustments (e.g., contrast, density) that functionally eliminate people or objects; retouching of people’s bodies depicted in the imagery to make their bodies look thinner or larger; and significant changes in color that diverge substantially from true‑to‑life colors, with the exception of black‑and‑white conversion.

During the application and judging process, submissions found by Getty Images to include unacceptably manipulated images will be disqualified. If, after seed funds are awarded, Getty Images discovers that images in the resulting submission may have been manipulated, the submission will be reviewed by Getty Images and BBC. If a majority of the reviewing panel determines one or more images to have been unacceptably manipulated, Getty Images may exercise its right to rescind the entire seed fund amount.

Selection Criteria: Recipients of the seed funds are decided entirely on merit and there is no element of chance involved. The criteria used by Getty Images to select the recipients shall be on originality, creativity of concept and technical ability compared to productions in the current photographic panorama for similar imagery or video.

Getty Images may reject any submissions it considers in its sole discretion to be immoral, obscene, profane or in violation of these rules.

Use of a false name or address will disqualify an applicant. Getty Images reserves the right to oblige any potential recipient to provide documentary proof of their identity.

You understand and agree that if you take or have taken any actions that may injure, tarnish, damage or otherwise negatively affect your reputation or the reputation and goodwill of Getty Images, that Getty Images may, in its sole discretion, exercise its right to rescind the entire award amount.
Seed Funds: Seed fund recipients will be selected by a panel of BBC and Getty Images employees, selected by Getty Images for their creative expertise and industry experience. Selection will be based on panels’ determination of applicant’s ability to execute the proposed Brief and produce an original artistic work on the basis of the above criteria, at panels’ discretion.

Getty Images will not be liable for any damage, loss or disappointment suffered by any person taking part or not being able to take part in the seed funding, including as a result of or in connection with any actual amount of seed funds distributed to a recipient.

Seed Fund Recipient Notification:
Recipients of the seed funds will be notified within the time frame specified in the Brief. Seed fund recipients may share the news of their selection as a seed fund recipient with others involved with the project but are asked to keep news of their award confidential until the seed fund winners are publicly announced through press alerts, Getty Images and/or BBC websites, and additional promotion.

Publicity:
Each seed fund applicant allows Getty Images and BBC the right to use their name, likeness and biographical information, as well as the right to select and use portfolio and Brief project images in connection with any and all Getty Images and BBC promotions and publicity, including the website, social media and exhibitions of the Image Set on Getty Images and BBC websites. All other use of applicant’s personal information by Getty Images shall be governed by Getty Images’ privacy policy which may be updated from time to time and found at: www.gettyimages.com/company/privacy‑policy and all other use of applicant’s personal information by BBC shall be governed by BBC’s privacy policy which may be updated from time to time and found at: https://www.bbc.co.uk/usingthebbc/privacy/.

Release:
By participating, applicants and seed fund recipients each agree to release, indemnify and hold harmless Getty Images, and BBC, each of its affiliates, partners and promotion and advertising agencies and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Entities”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in this promotion, or possession, acceptance and/or use or misuse of prize or participation in any promotion‑related activity and for any claims based on copyright, trademark, publicity rights, defamation or invasion of privacy and merchandise delivery.

Taxable Compensation:
Seed funds may be subject to various taxes depending on each recipient’s country of residence and/or citizenship, and location of their Brief project work. Getty Images cannot provide advice on tax matters and encourages all seed fund recipients to consult with an appropriate tax advisor.

Changes:
Getty Images reserves the right to amend seed fund rules and submission guidelines for the Image Set from time to time. If any such amendments should occur, they will be posted to the Brief page at https://contributors.gettyimages.com/article.aspx?article_id=8321 no later than 30 days prior to each application deadline date.
